The Client declares that s/he is over 18 or, where this is not the case, that s/he has parental permission to place an order on the Site.
Any order that is placed implies prior knowledge and acceptance without reservation of these General Terms and Conditions of Sale and all the information and instructions referred to in Articles L111-1 to L111-7 of the Consumer Code, and in particular:
- the essential characteristics of the Product, taking into account the means of communication used and the Product concerned;
- the price of Products and associated costs (e.g. delivery);
- the delivery date or timescale in which Le Delta du Mékong agree to deliver the Product;
- information concerning the identity of the seller, his/her postal, telephone and electronic contact details and his/her activities, if they do not appear in context;
- information relating to legal or contractual guarantees and their terms of use;
- operability of digital content and, where relevant, its inter-operability;
- the right of recourse to contractual mediation in the case of litigation;
- the information relating to the right to withdraw (existence, conditions, timing, conditions for exercising this right and withdrawal formula), to Product return fees, conditions of termination and other important contractual conditions.
Charges for connection and access to the Internet are the responsibility of the Client.
4.1 Recording orders
All new Clients must create a profile that will be accessible on the Site under the 'My Account' tab. Clients who already have a Client Account must identify themselves once they have validated an order, by filling in their email address and password if they are not already connected to their account. The Client accepts that entry of his/her email address and password is proof of his/her identity.
The Client agrees to ensure that details supplied are correct.
A Client wishing to place an order selects his/her choice of Product(s) by clicking on
'Add to my basket'.
4.2. Validation of orders
All orders are validated by the Client using a 'double click', which constitutes an irrevocable agreement that can only be opposed within the limits provided for in the General Terms and Conditions of Sale.
In legal terms, the so-called 'double click' process, associated with the authentication and non-repudiation procedure, as well as the protection of the integrity of messages, constitutes a valid electronic signature between the parties, in the same way as a handwritten signature. In the absence of evidence to the contrary, data recorded by Le Delta du Mékong constitutes proof of all transactions between Le Delta du Mékong and the Client.
Payment of orders are made either:
- by bank card (Visa, MasterCard, American Express or other credit cards)
- by PayPal
- or by bank transfer For bank transfers, the order will be reserved for the Client for a period of 7 days, for the bank transfer to take effect. If said transfer has not been effected within this time the order will be automatically cancelled.
Le Delta du Mékong reserves the right to offer new methods of payment.
Cards will be debited at the moment when the order is validated on the Site, unless the server is unavailable.
Confirmation of an order that has been validated by the Client will be sent by email prior to the dispatch of the order, and will make the sale final, subject to full payment of the price and the period relating to the right to exercise withdrawal. Clients are advised to save a copy of the Terms and Conditions of Sale when making an order.
In compliance with article L.122-1 of the Consumer Code, Le Delta du Mékong reserves the right to refuse any order or delivery, particularly in the case of:
- existing litigation with the Client,
- excessive or abnormal exchanges or returns,
- total or partial non-payment of a previous order by the Client,
- payments that are rejected by card providers and banking establishments,
- the non-payment, or partial payment of the order,
- use of a bank card not supplied by a French banking establishment.
Le Delta du Mékong will not be liable, in any circumstances, in this respect.
